This Privacy Policy describes how askwork.ai, operated by AskWork Community Services Ltd (ABN pending โ not-for-profit entity to be registered) ("we," "us," or "our"), collects, uses, and discloses your personal information. We are committed to protecting your privacy in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). By using this service, you consent to the collection and use of your information as described in this Policy. AskWork is operated as a not-for-profit community service. We do not generate profit from referrals or user data. As a non-profit service, we do not monetise your personal information.
2. What Information We Collect (APP 3)
We may collect the following types of personal information:
- Identity and contact information: nickname, email address (if provided)
- Employment information: job title, employment type, industry, employer details you share in chat
User Responsibility: Health and sensitive information: details about workplace injuries, physical or psychological health conditions, or workers' compensation matters that you voluntarily share in chat or uploaded documents
3. How We Use Your Information
We use your personal information for the following purposes:
(a) Triage: To assess your workplace situation and provide relevant general information; (b) Community referral: Where you request it, to connect you โ at no charge and with no commercial arrangement โ to independent legal services, community legal centres, or government agencies; (c) Service improvement and analytics: To improve the platform and monitor usage patterns (in de-identified form where possible); (d) Compliance: To comply with legal obligations.

4. Third-Party Disclosures
We may disclose your personal information to the following third parties:
Independent Legal Services (Non-Commercial)
Independent legal services: If you request a connection to a legal service, community legal centre, or government agency, your information (including conversation summaries) will be shared with that service. AskWork does not receive any fees or commissions from these connections. The referred service has its own privacy obligations.
Technology Providers
Technology providers: OpenAI (AI processing, servers in the USA), Replit (hosting, servers in the USA), Resend (email delivery). These providers are bound by contractual obligations but may not be subject to Australian Privacy Principles.
5. Cross-Border Disclosure (APP 8)
Your data is processed on servers located in the United States (including OpenAI for AI responses and Replit for hosting). By using this service, you expressly consent to the disclosure of your personal information to overseas recipients.
- We take reasonable steps to ensure these providers handle your data securely.
- You acknowledge that overseas recipients may not be subject to the Australian Privacy Principles.
- We may not be accountable for acts or omissions of overseas recipients under the Privacy Act 1988.
6. Data Security and Retention
We implement reasonable technical and organisational security measures to protect your personal information. Chat conversations and uploaded documents are automatically deleted from our active database after 12 months of inactivity. Anonymous conversation data may be retained in de-identified form for service improvement purposes. Once deleted, data cannot be recovered โ please maintain your own copies of important documents.
Despite our efforts, no internet transmission is 100% secure. We cannot guarantee the security of data transmitted through this platform.
7. Your Rights (APP 12 & 13)
You have the right to: (a) Access the personal information we hold about you; (b) Request correction of inaccurate or out-of-date information; (c) Make a complaint about how we handle your personal information. To exercise these rights, contact us at help@askwork.ai. We will respond within 30 days.
8. Notifiable Data Breaches
We are subject to the Notifiable Data Breaches (NDB) scheme under Part IIIC of the Privacy Act 1988. If we become aware of a data breach likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner (OAIC) as required by law.

9. Cookies and Tracking
We use only essential and session cookies required for basic website functionality and to maintain your chat session. Session cookies are deleted when you close your browser. We do not use advertising or marketing cookies. We do not track you across other websites. We do not use third-party analytics services.
10. Children's Privacy
This service is intended for workers in Australia and is not directed at children under 15 years of age. We do not knowingly collect personal information from children under 15. If you believe we have collected information from a child under 15, please contact us immediately at help@askwork.ai.
11. IP Address and Geographic Location
We use your IP address to determine your approximate geographic location (country, state/territory, city) to provide region-specific workplace rights information. We do not store your IP address permanently. This geolocation data is not linked to your identity and is used solely to improve the relevance of the information we provide.
