User Responsibility: You are strictly advised NOT to upload highly sensitive personal identifiers, such as Tax File Numbers (TFN), bank account details, or copies of passports, unless specifically required. We do not proactively filter this data and disclaim liability for its incidental collection.
3. Use of Artificial Intelligence and Accuracy Disclaimer
AI Processing: This service utilizes third-party Large Language Models (LLMs). AI can generate inaccurate, incomplete, or biased outputs (hallucinations).
No Liability for Errors: We do not guarantee the legal accuracy of AI-generated content. Your reliance on any information provided by the AI is strictly at your own risk.
4. International Data Transfers (APP 8)
Your data is processed on servers located in the United States (OpenAI and Replit).
Consent to Overseas Disclosure
By using this service, you expressly consent to the disclosure of your personal information to overseas recipients.
Acknowledgement
You acknowledge that while we take reasonable steps to ensure security, these overseas recipients may not be subject to the Australian Privacy Principles, and we may not be liable for their acts or omissions under the Privacy Act 1988.
5. Limitation of Liability and Indemnity
To the maximum extent permitted by law, askwork.ai and its parent company, Whales Regional Workforce Pty Ltd, shall not be liable for any direct, indirect, or consequential loss arising from:
- Data breaches caused by third-party service providers.
- Incorrect legal interpretations provided by the AI.
- Unauthorized access to your device or account.
6. Data Retention and Deletion
30-Day Auto-Deletion: For your protection, chat conversations and uploaded documents are automatically purged from our active database every 30 days.
Non-Recoverability: Once deleted, this data cannot be recovered for any legal or personal purpose. It is your responsibility to maintain independent copies of any documents uploaded.
7. Mandatory Disclosure
We reserve the right to disclose your personal information if required by law, regulation, or a valid court order from an Australian or United States authority.
